General terms and conditions for luxury villa rentals in Saint-Barthélemy
CHECK-IN AND KEY RETURN TIME
Check-in time: after 3:00 PM Key return time: before noon If the keys have not been returned by noon, an additional night will be charged.
DEPOSIT
A deposit representing the total rental amount must be paid. The contract will not be signed until we have received this amount and the signed reservation agreement, and until we have confirmed your reservation.
Sale Items
Only regular-priced items can be refunded. Sale items cannot be refunded.
BALANCE PAYMENT
The balance of payment must be paid no later than 60 days before your arrival. If the balance is not received by UNIQUE VILLAS within this timeframe, UNIQUE VILLAS has the right to cancel the reservation, without affecting its rights to claim cancellation fees, and to keep the deposit. For reservations made less than 60 days before the arrival date, the client must pay the full rental amount at the time of booking.
CANCELLATION BY THE CLIENT
The parties agree between themselves that if a Client wishes to cancel the reservation in whole or in part, or if the reservation is cancelled by UNIQUE VILLAS for non-payment, UNIQUE VILLAS is therefore entitled to the full rental price. If a Client wishes to cancel their reservation totally or partially, or if the reservation is cancelled by UNIQUE VILLAS for non-payment, UNIQUE VILLAS will retain the following percentage of the gross rental price: • 60 days before arrival: 20% of the gross rental amount • Between 59 and 30 days before arrival: 30% of the gross rental amount • Less than 29 days before arrival: 100% of the gross rental amount Exceptions: During the holiday season, between December 15 and January 10 of the following year, the cancellation conditions are as follows: • 90 days before arrival: 30% of the gross rental amount • Less than 89 days before arrival: 100% of the gross rental amount Cancellations must be made in writing and sent to UNIQUE VILLAS by email. No refund is granted in case of client absence, late arrival, modification after arrival of the number of people in the client's group, and early departure.
FORCE MAJEURE
In case of force majeure, which is an exceptional, unforeseeable, irresistible and external event that cannot be dealt with, UNIQUE VILLAS commits to offering its client a postponement of the stay, a credit valid for 18 months or a refund of all amounts that have been paid (excluding bank fees). Illnesses, accidents, transportation disruptions, etc. are not considered cases of force majeure. UNIQUE VILLAS informs and recommends to its clients that they have the possibility to take out travel insurance. Covid-19: Force majeure applies in the case where the client would be unable to travel due to the consequences of the resurgence of the pandemic such as: government measures limiting transport; national or international travel restrictions; border closures and/or confinement in the departure country or in Saint-Barthélemy; airport closures in the departure country or in Saint-Barthélemy. Force majeure does not apply if the client tests positive before the trip or cannot travel for medical reasons related to COVID-19.
MODIFICATIONS OR CANCELLATIONS MADE BY UNIQUE VILLAS
Although it is unlikely that UNIQUE VILLAS will make modifications to confirmed agreements, this may occasionally occur for reasons beyond their control. UNIQUE VILLAS will inform the client as soon as possible. If, for reasons beyond its control, UNIQUE VILLAS is unable to provide the property that was booked, it reserves the right to transfer the client to another similar villa. However, if this is not possible or if the Client does not wish to be transferred, UNIQUE VILLAS will cancel the reservation and refund the amount that would have been paid for the villa. UNIQUE VILLAS will in no case be held responsible for payment of travel cancellation fees.
CHANGES
Changes of villa during the client's vacation on the island are not allowed, unless there is a legitimate reason, such as major construction work or a serious technical problem in the villa. UNIQUE VILLAS will make these changes to the best of its ability.
VILLA OCCUPANCY
The number of bedrooms rented and the number of people allowed in the villa are limited to the agreed number of people and bedrooms for which payment has been made, generally on the basis of 2 people per bedroom. If a group arrives larger than expected, payment will be immediately made for each additional person or the group must leave the villa, without any refund being made. Exceptions can only be made for young children, if they sleep in a crib and do not occupy a bed in the villa.
SECURITY DEPOSIT / DAMAGE DEPOSIT
A security deposit will be held or authorization to use the credit card will be given in order to cover damages and additional costs. If the client is unable to settle fees at the key return and before departure, they authorize UNIQUE VILLAS to debit from their bank card on file all unpaid fees required by the representative and by UNIQUE VILLAS (including the balance due for the villa rental, telephone charges, breakage fees and all others) during the Client's vacation. UNIQUE VILLAS will assume no responsibility for payment of services provided to the Client by a third party.
BEHAVIOR
The client who signs this contract is responsible for their own behavior and that of their vacation group, which must be reasonable and acceptable. The client and other occupants agree to behave in a manner that does not damage the rented property. If the client does not respect the property, UNIQUE VILLAS is able to ask them, as well as the other occupants, to leave the villa.
PERSONAL VALUABLES
All valuables left unattended in the villa by the client are at their own risk. Neither UNIQUE VILLAS nor the villa owners (nor their employees) will be held responsible in case of loss or theft.
INSURANCE
Travel insurance, property owner insurance or other insurance policies are available and may cover you in case of serious unforeseen circumstances and delays likely to interrupt, delay or cancel your travel plans. Appropriate coverage must be taken out at the time of booking. The client's signature on the registration form confirms that the client is aware of the existence of such insurance and has taken out adequate coverage for this reservation.
CLAIMS
The descriptions of our properties are, to our knowledge, accurate and made in good faith. UNIQUE VILLAS will strive to respond to Client requests throughout the duration of the contract, but will refuse to be responsible for problems over which it has no control, such as failure on the part of water, gas or electricity suppliers. However, UNIQUE VILLAS will do everything possible to have these problems resolved as soon as they are notified. If the Client encounters problems during their vacation, they must immediately inform UNIQUE VILLAS. It is not possible for UNIQUE VILLAS to request repairs from the owner after the Client has left the villa if the Client did not inform UNIQUE VILLAS during their vacation. Claims made after the client has left the villa will not be taken into consideration. If the Client leaves the villa without UNIQUE VILLAS' authorization, they will lose all rights to a refund or reduction. No refund will be made, except in case of a serious problem not resolved within 24 hours or causing the client extreme or excessive inconvenience or significant discomfort.
LIABILITY WAIVER
The Client agrees to waive all claims and not to hold UNIQUE VILLAS, its managers, directors, employees, representative agents, villa owners and representatives responsible in case of bodily injury or death of the Client resulting from the occupation and use of the villa or pool (if applicable), except in case of extreme failure. The Client also agrees that this contract is governed by French law and is interpreted accordingly for all claims made against UNIQUE VILLAS.
VIOLATION OF RULES AND REGULATIONS
If a provision of this contract violates an applicable law or legal rule, that law or rule prevails, but only to the extent necessary for that particular matter, and in this case, the provision that is in violation is null and void, while the other provisions remain in force, the parties striving to replace this provision that violates a law or rule with a provision agreed upon between them, in order to maintain the balance of the contract as much as possible.
